Falling behind on payments happens: a job change, a medical bill, a divorce, a rate adjustment. What matters now is what you do next. The earlier you act, the more choices you keep, and the more of your equity stays in your pocket.
This page walks you through how pre-foreclosure works in North Carolina, the three main paths forward, and how to avoid the scams that target homeowners in this situation.
How Pre-Foreclosure Works in NC
- Missed payments come first. Federal rules generally keep your servicer from starting a foreclosure until you are more than 120 days behind. That window is your best time to act.
- You’ll get notices. For most primary-residence loans, North Carolina requires your lender to send a pre-foreclosure notice at least 45 days before filing.
- NC uses a hearing before the clerk. Most foreclosures here go through a hearing before the Clerk of Superior Court, not a full lawsuit. You have the right to attend.
- Even after a sale date is set, timing matters. NC has a 10-day upset bid period after the foreclosure sale. Selling on your own terms before that point is almost always the better outcome.
This is general information, not legal advice. For your specific situation, talk with a real estate attorney or a free HUD-approved housing counselor.
Your 3 Options to Stop Foreclosure
Option 1
Reinstate Your Loan
Pay the past-due amount plus fees to bring the loan current. Best if the hardship is behind you and you can catch up in one step.
Option 2
Modify Your Mortgage
Ask your servicer for a modification, forbearance, or repayment plan that changes your terms so the payment fits. Best if you want to stay and can afford an adjusted payment.
Option 3
Sell Smart and Fast
List and sell on the open market before a sale date, pay off the loan, and keep your equity. Best if the payment no longer fits your life and you have equity to protect.
How to Spot a Foreclosure Scam
Homeowners in pre-foreclosure get flooded with letters, calls, and texts. Walk away from anyone who:
- Asks you to sign your deed over to them, even “temporarily.”
- Wants an upfront fee to “save your home” or negotiate a loan modification.
- Tells you to stop talking to your lender or to send your payments to them instead.
- Pressures you to sign today, or won’t put the offer in writing.
A licensed broker works for you, puts everything in writing, and gets paid at closing, not before.
